Terms of Service

These Terms govern your use of Typing Safari (the “Service”), operated by Fynaxis. By using the Service you agree to these Terms. If you do not agree, do not use the Service.

Eligibility & children

If you are under the age of majority where you live, you may use the Service only with the involvement of a parent, guardian, school, or camp who agrees to these Terms on your behalf. A teacher, camp operator, or parent who adds others (e.g. students) to a group confirms they are authorized to do so and to accept these Terms for those people.

Accounts & rosters

You are responsible for activity under your account and for keeping your credentials secure.
Group administrators are responsible for the roster members they add and for having the right to add them.
Provide accurate information, and let us know of any unauthorized use of your account.

Acceptable use

You agree not to:

break the law, infringe others’ rights, or upload content you don’t have the right to use (this includes “custom text” you paste or upload);
upload or share content that is unlawful, harmful, hateful, or inappropriate, particularly given the Service is used by children;
disrupt, attack, scrape, reverse-engineer, or attempt to gain unauthorized access to the Service or other users’ data; or
manipulate leaderboards, certificates, or results, or use the Service to harass others.

Your content

You keep ownership of text you provide. You grant us a limited license to process and display that text solely to operate the Service for you. You are responsible for the content you provide and confirm you have the rights to use it.

Subscriptions & payments

Core features are currently offered free of charge. We may offer paid plans (including individual, family, and per-seat school/group licenses). If you purchase a paid plan, the price, billing period, renewal, and cancellation terms shown at checkout apply, and paid features remain available for the period you paid for. Taxes may apply.

Intellectual property

The Service, including its software, lessons, designs, and trademarks, is owned by Fynaxisor its licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

Leaderboards & certificates

Scores, rankings, and certificates are provided for educational and motivational purposes, are based on the data submitted, and are not guarantees of skill or qualifications.

Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that data will always be preserved.

Limitation of liability

To the maximum extent permitted by law, Fynaxis will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising from your use of the Service. Where liability cannot be excluded, our total aggregate liability for any claim is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) CAD $100.

Termination

You may stop using the Service at any time. We may suspend or terminate access if these Terms are violated or to protect the Service or its users. Sections that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of Canada, without regard to conflict-of-laws rules. You agree that any dispute will be brought exclusively in the courts located in the Province of Nova Scotia, Canada, and you consent to their personal jurisdiction.

Changes to these Terms

We may update these Terms and will revise the “Last updated” date above. Continued use after changes means you accept the updated Terms.
